In March 2017, the Associated Press ("AP" or "plaintiff") and the United States Department of State ("State" or "defendant") filed a Stipulation of Dismissal "pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(ii)." Dkt. # 106. Federal Rule 41(a)(1)(A)(ii) states that plaintiffs may dismiss an action when the file a "stipulation of dismissal signed by all parties who have appeared." The stipulation was signed by counsel for AP and State, but it was not signed by counsel for defendant-intervenors BAE Systems, Inc. or BAE Systems PLC. The purported stipulation therefore fails to comply with the requirements of Rule 41(a)(1)(A)(ii) and is ineffectual. See 8 Moore's Federal Practice § 41.34 (Matthew Bender 3d ed. 2016) ("Once intervention has been granted, the claims of the intervenors may not be dismissed on the bases of a stipulation signed only by the original parties.").
