FOIA Project Annotation: A federal court in Delaware has ruled that investigative journalist William McMichael is entitled to attorney's fees for his request to the FBI for records concerning the theft of jewels belonging to the Royal Family of Hesse by U.S. troops at the end of World War II. On September 1, 1961, a plane departing from Malmstrom Air Force Base in Montana crashed in the western part of the state. The airplane was searched after the crash; in it were remnants of the Hesse jewels, which were recovered by the U.S. government. McMichael decided to write a book about the case and submitted a FOIA request to the FBI for records about the case. The FBI told McMichael that it located 7,250 pages of responsive records. The FBI told McMichael that his request was on the complex track but that if he would break his request into multiple requests of no longer than 950 pages, it could be processed more quickly. McMichael decided to break down the request but after his request remained unassigned, he filed suit. The FBI ultimately processed the request and McMichael filed a motion for $60,732 in attorney's fees for the Philadelphia law firm of Troutman Pepper Hamilton Sanders. Magistrate Judge Christopher Burke found that disclosure of the records was in the public interest. He noted that "there seems to be no dispute that the Hesse jewel theft was a significant historical event. Thus, this subject matter is surely not simply of 'private concern.' And although the Court need only assess the potential public value of the information Plaintiff sought via the FOIA, here the information actually received seems as if it will be of real public benefit." Burke rejected the FBI's claims that the records were too old to be of historical value. He indicated that "nor is it disqualifying that the Hesse jewel theft and the FBI's investigation occurred a long time ago. If the matter is one of significant public interest, then FOIA requests that enable the public to better understand those events â€" and the government's investigation thereof â€" provide a measurable public benefit, even if the events are not of recent vintage." Buke then found that the commercial or personal interest in the records slightly favored McMichael. He pointed out that "here, the record (including the evidence of Plaintiff's lengthy history of reporting on this type of subject matter) suggests that the FOIA requests were primarily motivated by a scholarly interest in uncovering facts of significant public interest â€" and not by a desire for pecuniary gain." Burke found that the agency had acted unreasonably because of its long delay. He noted that "in light of this record, the Court concludes that: (1) Plaintiff was the victim of lengthy delay in the processing of his original FOIA request; and (2) Defendant has not credibly invoked any statutory basis for that delay." Burke found that McMichael's calculation of his fee request was appropriate and awarded him $59,332.
