2021-08-12 | | ORDER (by docket entry only). Plaintiff's motion for attorneys' fees (Dkt. 52 ) relies on the sworn declaration of attorney Richard L. Robbins (Dkt. 52-1). Mr. Robbins opines that the hourly rate charged by Plaintiff's attorneys and paralegals in this case is comparable to (or less than) the hourly rate charged by similar attorneys and paralegals in the Atlanta area. (Dkt. 52-1 at paragraphs 14-15.) Plaintiff should submit evidence, no later than August 18, 2021, that this statement holds true specifically for the kind of services provided by Plaintiff's attorneys and paralegals in this case. See Norman v. Hous. Auth. of City of Montgomery , 836 F.2d 1292, 1299 (11th Cir. 1988) ("A reasonable hourly rate is the prevailing market rate in the relevant legal community for similar services by lawyers of reasonably comparable skills, experience, and reputation.... [S]atisfactory evidence necessarily must speak to rates actually billed and paid in similar lawsuits ." (emphasis added)); see also Eley v. D.C. , 793 F.3d 97, 104 (D.C. Cir. 2015) ("Absent from [Plaintiff's] submission, however, is evidence that her requested rates are in line with those prevailing in the community for similar services, i.e. , IDEA litigation.... [Plaintiff] has not met her burden of justifying the reasonableness of the rates."). Relatedly, Plaintiff claims in its brief that Mr. Robbins' "experience does include[] involvement with numerous FOIA and Open Records Act disputes, both directly and in a supervisory role." (Dkt. 59 at 10.) Plaintiff should also submit evidence supporting and elaborating on this assertion no later than August 18, 2021. Ordered by Judge Michael L. Brown on 8/12/2021.
