Case DescriptionCitizens for Responsibility and Ethics in Washington submitted FOIA requests to the Department of State and U.S. Agency for International Development for records concerning the briefing call on international religious freedom held by Secretary of State Mike Pompeo on March 18, 2019. CREW also requested a fee waiver. Both agencies acknowledged receipt of the requests. USAID told CREW that its request did not adequately identify the records sought. CREW agreed to narrow the scope of its request. USAID also told CREW it had place the organization in the news media category, mooting CREW's request for a fee waiver. After hearing nothing further from either agency, CREW filed suit.

FOIA Project Annotation: Judge Reggie Walton ruled that the Department of State properly responded to requests from CREW and the Reporters Committee for records concerning a telephone conference call on international religious freedom on which then Secretary Mike Pompeo participated. The agency sent the requests to the Office of the Executive Secretariat, the Bureau of Global Public Affairs, and the Office of Religious Freedom for searching. In response to CREW's request, DOS located a series of responsive records in bits and pieces, ultimately disclosing 35 records in full and 44 records in part. In response to RCFP's request, the agency also released some records in full and others in part. The agency cited Exemption 1 (national security), Exemption 5 (privileges), and Exemption 6 (invasion of privacy) for bases for withholding records. The court consolidated the cases in February 2020 and the parties filed motions for summary judgment. CREW and RCFP challenged the agency's claims under the deliberative process privilege. The plaintiffs argued that DOS had failed to show who was responsible for making the claims in the first place. Walton indicated that problem had now been resolved by a subsequent affidavit provide by the agency, noting that 'this subsequent disclosure is sufficient to foreclose the Court from totally concluding that the Department's Exemption 5 redactions were inappropriate due to a purported failure to identify the relationships between communicators." Walton then turned to a discussion of the specific Exemption 5 challenges. CREW and RCFP argued that DOS had not identified agency staff who made the decision to withhold records under Exemption 5. However, Walton clarified the issue, noting that the second declaration from Eric Stein, the DOS FOIA Officer, explained that "the press-relations staffs' role in the decisionmaking-process and the process the Office of Press Operations utilizes in exercising its media related authority. In the email communications identified by plaintiffs with Exemption 5 redactions, the Office of Press Relations and the identified employees make up most, but not all, of the senders and direct 'To' recipients." Walton added that "the subsequent disclosure is sufficient to foreclose the Court from totally concluding that the Department's Exemption 5 redaction were inappropriate due to a purported failure to identify the relationship between communicators." CREW and RCFP specifically questioned an email chain regarding logistical concerns regarding the scheduling of the calls. Walton agreed, noting that "although the communications preceded the call, the reference to the individual whose name was redacted was not deliberative. This email chain concerns discussions purely related to an administrative matter that occurred for the purpose of determining, categorically, who was invited to the call, and the Operations Center simply executed the Press Office's instructions." DOS argued that the email was deliberative until the call was actually made. However, Walton observed that "this argument blurs the line between the predecisional and deliberative considerations that the Court must make. Even if the agency's final determination only occurred at the onset of the call, that does not make the email inherently deliberative." He added that "furthermore, it is difficult to see how the release of this administrative exchange will discourage the free exchange of ideas within the agency." Walton pointed out that "as indicated by the information contained in the relevant email chain, there was no 'exchange of ideas' here at all." However, Walton rejected CREW and RCFP's challenge to withholding a draft schedule of calls and emails dealing with how to respond to press inquiries, finding both of them qualified for the deliberative process privilege. The agency withheld portions of email addresses under Exemption 6. Walton found that the agency had properly withheld the username for Pompeo's email address, but disagreed with the agency that domain names were even qualified for protection under Exemption 6. Walton indicated that "the Court concludes that the Department has failed to show that [an employee's] person email domain, alone, and without the disclosure of the accompanying email username, is specific enough to constitute a 'personnel, medical or similar file' within the meaning of Exemption 6."
