Case DescriptionNovo Legal Group submitted a FOIA request to U.S. Immigration and Customs Enforcement for records concerning contracts between the agency and GEO Group for housing ICE detainees. The agency acknowledged receipt of the request. After hearing nothing from the agency in three months, Novo Legal Group filed an administrative appeal. After the agency still failed to respond, Novo Legal Group filed suit.

2022-04-0738ORDER TO SHOW CAUSE: On September 3, 2021 the parties informed the Court that they had resolved all remaining substantive issues, and that they were negotiating concerning plaintiff's request for attorney's fees. ECF No. 34. The Court requested a status report by October 8, 2021. ECF No. 35. On October 8, 2021 the defendant informed the Court that despite multiple requests, the plaintiff had not provided defendant with a formal request for attorney's fees or supplied any supporting documentation. ECF No. 34. The Court set a deadline of November 8, 2021 for the plaintiff to file any motion for an award of attorney's fees. ECF No. 37. No motion was ever filed. It appears, therefore, that because all issues but attorney's fees have been resolved, and the deadline to move for an award of attorney's fees has long passed, there is nothing left to be determined in this case. The Court therefore orders plaintiff to show cause no later than April 21, 2022 as to why this case should not be dismissed without prejudice for failure to prosecute. By Judge R.
