Accordingly, the Court also denies as moot the parties' 22 joint motion to stay the dispositive motions briefing schedule. The interim production of further records and pending final settlement in the underlying contract dispute have at least narrowed the scope of this dispute, if not eliminated the need for continued litigation altogether. Plaintiff may renew its motion if necessary as events unfold.
