FOIA Project Annotation: Judge Trevor McFadden has ruled that the Bureau of Prisons and the United States Parole Commission properly responded to FOIA requests from John Newman, a professor at James Madison University specializing in the history of the Kennedy administration and Cold War America, concerning records on former Cuban exile, Manuel Antonio Carlos Veciana Balance (Veciana). Veciana was convicted on two felony drug charges and sentenced to seven years' incarceration and three years of parole. He was ultimately released in 1981 and his supervision ended in 1984. Newman submitted FOIA requests to the Bureau and the Parole Commission for records related to Veciana. The Bureau released four partially redacted pages and explained that any remaining records had been destroyed. The Parole Commission found no records and indicated that the reason that it did not find any records could possibly reflect that he did not serve a sentence eligible for parole, he might be serving his term of parole under a state sentence, or he did not serve the minimum term to be eligible for parole. Newman's counsel contacted the Commission and explained none of those reasons applied to Veciana. The Commission conducted another search using Veciana's date of birth but still found no records. Newman's counsel was able to provide the name under which the Bureau kept Veciana's records as well as his BOP file number. However, after conducting multiple searches using variations of Veciana's names, the Commission's search still came up short. McFadden agreed with the agency that it had conducted an adequate search. He pointed out that "there is an obvious explanation for this absence [of records]. Veciana's file 'would have been transferred to the National Archive and Records Administration' ten years after his sentence terminated. Here, relevant files would have gone to NARA's Wahington National Records Center. And the Commission's copies of those files would have been destroyed once it received a Records Transmittal and Receipt (SF-135)." NARA was unable to locate the relevant transfer receipt. McFadden observed that "again, there is a straightforward explanation for the missing receipt â€" 'USPC only possessed archive transfer receipts and archive disposition receipt from 1999 through the present date.'" McFadden noted that "these searches were more than adequate." He pointed out that "the Commission's searches of its physical records were similarly exhaustive â€" the Commission searched physical files for every possible alphabetical category under which Veciana's files might have been kept. And when it became clear responsive records would most likely be at WNRC, the Commission took reasonable (but unsuccessful) steps to obtain those records." Like other cases in which he has ruled on similar fishing expeditions, McFadden indicated that "this case is yet another example of the 'mismatched incentives' that FOIA creates. As the court explained in [its decision in a similar case], nonprofit FOIA requesters like Newman pay little to nothing for their FOIA requests. So they do not internalize the costs of a wild goose chase like this one. This case has tasked multiple attorneys at three agencies (includes the U.S. Attorney's Office) and several specialists in the search for decades-old inmate records that by regulation should have been transferred or destroyed years ago. Unsurprisingly, they were. But the cost of this predictably fruitless search is borne by the agencies, and ultimately, American taxpayers."
