The agency acknowledged receipt of the requests and took a 10-day extension in which to respond. After hearing nothing further from the agency, Energy Policy Advocates filed suit.

2024-01-30MINUTE ORDER: Upon consideration of 46 the parties' joint motion for an extension of time, and the entire record herein, it is hereby ORDERED that the motion is GRANTED; it is further ORDERED that, by not later than March 13, 2024, plaintiff shall file a response to defendant's second motion for summary judgment and any cross-motion for summary judgment or the parties shall notify the Court that the case has settled; it is further ORDERED that if the parties proceed with summary judgment, the following schedule shall govern briefing: defendant shall file a reply in support of its motion and response to any cross-motion by not later than April 3, 2024, and plaintiff shall file a reply in support of any cross-motion by not later than April 17, 2024.
