In addition, the government's pending dispositive motion confirms that the issues in this FOIA case are not particularly complex and are likely to be resolved by the Court's independent review of the summary judgment record. Having revisited the factors for appointing counsel, LCvR 83.11(b)(3), and given the limited availability of pro bono resources, the Court finds an appointment unwarranted. Consequently, the time for Plaintiff to respond to Defendant's motion for summary judgment is hereby ENLARGED to July 14, 2023. As previously warned, Plaintiff's failure to file a response within the additional time provided may result in entry of judgment in Defendant's favor or dismissal of the case for failure to prosecute.
