2023-04-04 | 22 | TEXT ORDER denying without prejudice 20 Plaintiff's First Motion to Compel Production of Documents. Based on the representations made by Defendant in its response brief (Doc. 21 ), it appears that meaningful conferral on the requested relief will likely prove useful in resolving many of the disputed issues. Additionally, Plaintiff did not file a supplemental certification that counsel continued to diligently attempt to confer on the motion for three days after the motion's filing as required by M.D. Fla. R. 3.01(g)(3). If after a good-faith conference between counsel regarding the requested relief there are still issues remaining, Plaintiff may renew his motion in full compliance with the Court's local rules. If Plaintiff renews his motion, Plaintiff must include in the motion's legal memorandum the legal basis for a motion to compel as opposed to a motion for summary judgment. See Miscavige v. I.R.S. , 2 F.3d 366, 369 (11th Cir. 1993) ("Generally, FOIA cases should be handled on motions for summary judgment, once the documents in issue are properly identified.").
