2023-04-20 | | MINUTE ORDER: Upon consideration of Plaintiff's emergency motion for expedited briefing and ex parte , in camera review, Dkt. 18 , Defendant's opposition, Dkt. 21 , and Plaintiff's reply, Dkt. 23 , as well as the parties' submissions at oral argument, it is hereby ORDERED that the motion is DENIED. With the parties' input, the Court set a briefing schedule in January of this year. Although Plaintiff contends that it subsequently learned important new information that warrants revisiting that schedule (midway through the briefing process), the Court is unpersuaded. Plaintiff premises its request for expedition, in substantial part, on information that it says first came to its attention when Defendant filed the declaration of Michele Mital, along with its motion for summary judgment, on March 2, 2023. Plaintiff's motion for expedition says: "In its recently filed summary judgment motion, FDA for the first time revealed the CTP Director's extraordinary oversight over JLI's application and that she told the Office of Science what the grounds for its decision should be." Dkt. 18-1 at 15. For support, Plaintiff then cites to paragraphs 16-18 of the Mital Declaration. The most relevant information contained in those paragraphs, however, appeared months earlier, before the Court set the briefing schedule, in Defendant's Notice of the Anticipated Bases for Defendant's Proposed Motion for Summary Judgment. Dkt 11 at 4, 6. Paragraph 18 of the Mital Declaration, for example, says that "while the Additional Disciplines TPL Review Memo reflects that the Director of OS concurred with the TPL's findings and conclusion, it expressly explains that OCD advised OS that OCD would review any conclusions reached by OS for this bundle before those conclusions became a final agency decision, and that OCD has not reviewed the findings and conclusions in this TPL Review (Additional Disciplines)." Dkt. 16-2 at 5 (Mital Decl. para. 18) (cleaned up). That language parallels Defendant's earlier statement: "[W]hile the Additional Disciplines TPL reflects that the Director of OS concurred with the TPL's conclusions, it specifically explains that OCD advised OS that OCD would review any conclusions reached by OS for this bundle before those conclusions became a final agency decision, and that OCD has not reviewed the findings and conclusions in this TPL Review (Additional Disciplines)." Dkt. 11 at 6 (cleaned up). The Court also notes that Plaintiff has failed to identify any heightened need for expedition. To be sure, one of the goals of FOIA is to provide prompt transparency regarding the operation of the government, particularly on matters of substantial public interest, and the Court does not doubt that Plaintiff has a keen interest in obtaining access to the disputed record as soon as possible. But the Minnesota litigation that Plaintiff featured in its motion for emergency relief was recently settled, and Plaintiff has failed to identify any similarly pressing matter. As far as the Court can discern, no deadline is approaching in the administrative proceeding and, in any event, Plaintiff will not be without a remedy if an important portion of the administrative record is omitted. Moreover, notwithstanding FOIA's focus on the public interest - beyond the interest of an individual FOIA litigant - it is noteworthy that Plaintiff is not a party to the California litigation that it now invokes in support of its emergency motion. Nothing distinguishes this case from many other FOIA cases involving records of broad public interest, and, in any event, accelerating the briefing schedule in this case by a week or two will have no meaningful impact on the public interest. The Court, accordingly, DENIES Plaintiff's request to modify the existing briefing schedule. If Plaintiff would like to file its final brief early, it is, of course, welcome to do so. Plaintiff's request that the Court direct Defendant to file a copy of the record at issue with the Court for ex parte , in camera review presents a closer question. Courts have "broad discretion" in deciding whether to order such review. Larson v. Dep't of State , 565 F.3d 857, 870 (D.C Cir. 2009). That said, the D.C. Circuit has also cautioned that "a court should not resort to [ ex parte , in camera review] routinely on the theory that 'it can't hurt.'" Id. (quoting Ray v. Turner , 587 F.2d 1187, 1195 (D.C. Cir. 1978)). The D.C. Circuit has set forth a range of factors for courts to consider when exercising their discretion to order ex parte , in camera review : (a) judicial economy, (b) the conclusory nature (or not) of the agency affidavits, (c) bad faith on the part of the agency, (d) whether the actual content of the document is disputed, (e) whether the agency is the one who proposed in camera inspection, and (f) whether there is a strong public interest in disclosure. See Allen v. CIA , 636 F.2d 1287, 1298-99 (D.C Cir. 1980), overruled on other grounds by Founding Church of Scientology of Washington D.C. v. Smith , 721 F.2d 828 (D.C. Cir. 1983). On the present record, the Court is unpersuaded that ex parte , in camera review is warranted and therefore DENIES Plaintiff's request for the same. It will, however, deny that request without prejudice. If, after briefing is complete, the Court concludes that its resolution of this matter will be aided by ex parte , in camera review of the record at issue, the Court will at that time direct Defendant to file a copy the record under seal and ex parte .
