2024-10-24MINUTE ORDER: Upon consideration of the parties' status reports, Dkts. 31 , 32 , and 34 , as well as the discussion at the status conference held on October 4, 2024, it is hereby ORDERED that Defendant shall begin processing the responsive documents no later than August 9, 2026 and, to the extent possible and consistent with the placement of the request in the queue of similarly situated requesters, at an earlier date. It is further ORDERED, moreover, that the FDA shall file status reports with the Court every 90 days (starting on December 2, 2024) updating Plaintiff and the Court regarding Plaintiff's placement in the queue, the agency's best estimate of when it can begin processing the request, any new and unanticipated demands on the agency's FOIA staff, and the number of agency employees working on processing FOIA requests. In its status report from August 9, 2024, Dkt. 31 , Defendant represented that the "agency's best estimate of when it will begin processing Plaintiff's FOIA request" is "when it reaches the front of the Complex Track in approximately 24 to 36 months." Dkt. 31 at 5. The Court appreciates the unusual and extraordinary demands placed on the FDA in other litigation and also recognizes that other, similarly situated FOIA requesters filed their requests before the request at issue in this case was filed and that it would be unfair to push those requests further back in the queue. The Court also recognizes that the FDA has hired and trained additional staff to assist with the extraordinary burden that it currently faces. But, at the same time, the Court understands that the purposes of FOIA require agencies to process FOIA requests as promptly as possible and that the delay in this case--even if unavoidable in light of the demands placed on the FDA in other litigation--is antithetical to the purposes of FOIA. As a result, all that the Court can do is require the most expeditious processing of the request at issue, consistent with reality. This may require the agency to hire yet additional staff, and it may require the agency to ensure that other similarly situated FOIA requesters are not allowed to jump the queue in front of Plaintiff in this case. For present purposes, however, the Court will simply order that processing begin no later than 24 months from the filing of the FDA's August 9, 2024 status report, Dkt. 31 , that the agency make its best efforts (including, to the extent possible hiring yet additional staff) to process this request as soon as it can possibly do so, consistent with the rights of other FOIA requesters and the other burdens the agency currently faces, and that the FDA keep Plaintiff and the Court updated regarding its backlog, resources, and ability to process complex FOIA requests. 2025-04-09Minute Order from Proceedings held before Judge Randolph D. Moss on 4/9/25: In light of the parties' submissions and arguments at the April 9, 2025 status conference, it is hereby ORDERED that Plaintiff's Motion for Order for Timely Processing, Dkt. 35 , is DENIED without prejudice and that the procedures set forth in the Courts October 24, 2024 minute order shall remain in place. For the reasons stated on the record, the Court is not, at this time, convinced that Plaintiff is entitled to expedited processing, which Plaintiff has raised "only defensively." Plaintiff, in its Complaint, Dkt. 1 , did not clearly request expedited processing as a form of relief or frame the complaint as a challenge to the denial of expedited processing, and Plaintiff's prior filings have raised the issue only "defensively," in response to the government's motion for an Open America stay. Plaintiff, however, now asserts that it should be entitled to expedited processing, notwithstanding the important responsive records that the agency has already released, see Dkt. 41 . As framed at oral argument, the question is now whether Plaintiff is entitled to expedited processing in the existing complex queue, separate and apart from the question whether the Open America stay is proper with respect to the FDA's other FOIA processing resources. Because Plaintiff has not previously raised or briefed that stand alone argument, and because it is unrelated to the question whether the Court should continue the Open America stay with respect to the agency's processing of records using other agency resources, the Court will deny Plaintiff's pending motion without prejudice. That decision, however, is without prejudice and does not foreclose Plaintiff from seeking appropriate relief, if any, separate and apart from relitigating the propriety of the Open America stay. It is therefore ORDERED that the Court's prior orders remain in place and that Defendant shall begin processing any further responsive records in this matter on or before August 6, 2026. Defendant shall also continue to file status reports every 90 days, with the next status report to be filed on or before July 8, 2025. Finally, as the Court explained on the record, the FDA must take all steps now to ensure that it is able to comply with the Court's order--issued many months ago--requiring the agency to begin processing records in this case no later than August 6, 2026. The agency has been on notice of this requirement for almost six months now, and it will have another sixteen months to ensure that it is able to comply. It is no excuse--and it will be no excuse--for the agency to assert that it is understaffed, given this extended notice. In this respect, the Court is concerned by the FDA's representation that its FOIA staff is decreasing, rather than increasing, in size and that a hiring freeze has prevented the FOIA office from hiring replacements or expanding its staff. The failure of Congress to appropriate funds sufficient for an agency to meet its FOIA obligations is one thing. It is another thing altogether for any agency simply to decline to expend the funds that Congress has provided. As the Court has previously observed, it seems implausible that "an agency can avoid its obligations under FOIAincluding the obligation to process a request in an efficient and prompt mannerby simply implementing a reduction-in-force that either terminates or places on administrative leave" the agency's FOIA staff. See Ctr. to Adv. Sec. in America v. U.S.A.I.D. , No. 24-cv-3505, 2025 WL 763735, at *2 (D.D.C. Mar. 11, 2025). The same, of course, applies to the attrition of staff that cannot--or is not--remedied due to an asserted hiring freeze. To the contrary, "FOIA's demand for expedition--and, indeed, more generally, FOIA's requirement that agencies release all non-exempt, responsive recordswould be rendered meaningless if an agency could avoid these statutory obligations through the simple expedient of dismissing [or declining to replace] its FOIA staff." Id. In short, the agency stands forewarned that the Court expects it to comply with its obligations under FOIA and that it may not evade those obligations by dismissing or failing to replace the FOIA staff that is needed to do so. It is therefore ORDERED that Government counsel shall ensure that the agency's management is made aware of this order and shall notify the Court in the future status reports regarding FDA/FOIA staffing levels and the agency's efforts to ensure that it has sufficient staff to begin processing the instant FOIA request (without requiring the Court to move this request above others in the queue) on or before August 6, 2026.(Court Reporter Sherry Lindsay) (zglw) (Entered: 04/09/2025)
