On March 15, 2023, plaintiff Michael John Sarno filed a six-count complaint against the United States Department of Justice; the Bureau of Alcohol, Tobacco, Firearms and Explosives; the Federal Bureau of Investigation; the Office of Information Policy; and the Office of Government Information Services. Pursuant to Federal Rule of Civil Procedure 4(m), a defendant must be served "within 90 days after the complaint is filed," or "the court - on motion or on its own after notice to the plaintiff - must dismiss the action without prejudice against that defendant or order that service be made within a specified time." Fed. R. Civ. P. 4(m). As of July 5, 2023 - 112 days after the complaint was filed - plaintiff had not completed service. See Notice of Error (June 26, 2023) ("U.S. Attorney has not been served and a summons has not issued."). Therefore, the Court ordered plaintiff to "complete[] service on the United States in accordance with Federal Rule of Civil Procedure 4(i)... [by] August 2, 2023." Min. Order (July 5, 2023). Upon plaintiff's motion for an extension of time, the Court extended this deadline to August 23, 2023. Min. Order (Aug. 2, 2023); see Pl.'s Mot. for Extension of Time to Complete Serv. on the United States 14 . Plaintiff then submitted an affidavit of mailing on August 23, 2023, averring that counsel mailed a copy of the summons and complaint to the "United States Department of Justice, et al" on July 26, 2023. Aff. of Mailing 15 . However, this affidavit does not aver or contain a certified mail receipt showing that the summons and complaint was specifically delivered to the United States Attorney for the District of Columbia. All it shows is that a copy of the summons and complaint was mailed to the "United States Department of Justice, et al."
