Plaintiff filed a 34 motion requesting a briefing schedule on December 18, 2024. Plaintiff's motion included statements indicating that Defendant has been unresponsive at points throughout these proceedings and partially noncompliant with prior court orders. The Court directed Defendant to respond and to address any non-compliance with prior orders. Given the holidays, the Court gave Defendant more than two weeks and until January 8, 2023, to file a response. Defendant has now filed a request for extension on the day the response was due. The request states additional time is needed due to leave that had accrued and provides general information about civil case loads, without providing any specific information as it relates to Defendant's counsel. It does not, for instance, provide dates of leave or specific conflicting deadlines, such that the Court could meaningfully evaluate whether the extension is warranted. The motion also does not indicate why an extension could not have been sought before the day the response was due. Given Defendant's failure to file a response, the Court may treat points made in Plaintiff's motion as conceded. The parties are instructed to jointly email the courtroom deputy, chashawn_white@dcd.uscourts.gov, by January 10, 2025, with at least three 30-minute periods that work for both parties between 2:00-4:00pm on January 16, 22, or 23. The Court is amenable to a video hearing if both parties consent. To the extent a party is not able to appear on those days due to previously planned leave or a conflicting court hearing or deadline, that party should file an explanation with the Court that includes meaningful specificity, including the relevant dates and case numbers.
