Case DescriptionBrett Kimberlin submitted two FOIA requests to the Department of Justice. The first request asked for records concerning the use of microscopic hair evidence. The second request was for records on Kelly James Merritt, a deceased informant. The agency acknowledged receipt of the requests but denied them because they could find no responsive records. Kimberlin then filed suit.
