Plaintiff's deadline for responding is January 6, 2025. Without acknowledging that deadline, plaintiff now moves to stay the case "until further notice" because he was placed in segregation, and "all [his] material[s] necessary to submit a meritorious response were taken." Dkt. 35 . He provides no other details. I will not stay the case indefinitely, but I will GRANT plaintiff's motion in part as follows: plaintiff's response deadline is extended to January 27, and defendant's reply deadline is extended to February 6. If plaintiff needs additional time, he will have to file a new motion that includes the following: (1) a statement made under oath explaining why plaintiff is unable to file his response to defendant's summary judgment motion, what specific resources he needs but does not have access to, what prison staff have done to prevent him from obtaining what he needs, and what steps he has taken to obtain what he needs; (2) any evidence plaintiff has supporting his motion, such as a statement from prison staff or policies or procedures showing that prisoners in plaintiff's status are not allowed to keep legal materials and do not otherwise have access to legal materials; and (3) an estimate of how much additional time plaintiff needs and what that estimate is based on.
