2025-01-29MINUTE ORDER. At today's hearing, the parties stated that the sole issues remaining are (1) Defendant's redactions under FOIA Exemption 3, and (2) Defendant's Glomar responses, see Phillippi v. CIA , 546 F.2d 1009 (D.C. Cir. 1976), which Defendant asserts under FOIA Exemptions 6 and 7(c). During the hearing, Defendant offered to provide Plaintiff with a declaration from the agency giving context for these exemptions. Defendant shall provide its declaration by February 28, 2025. The parties shall file a joint status report advising the Court of any remaining issues that are appropriate for summary judgment briefing by March 7, 2025. Additionally, the Court adopts the parties' proposed summary judgment briefing schedule. Defendant shall file its motion for summary judgment by April 4, 2025. Plaintiff shall file its cross-motion for summary judgment and its opposition to defendant's motion for summary judgment by June 3, 2025. Defendant shall file its reply in support of its motion for summary judgment and its opposition to Plaintiff's cross-motion for summary judgment by August 4, 2025.
