FOIA Project Annotation: A federal court in New York has ruled that Rolling Stone Magazine is not entitled to expedited processing for its request to the FBI for records concerning Henry Kissinger. The request was submitted after Kissinger's death, citing his obituary in the Washington Post. In supporting its claim for expedited processing Rolling Stone explained that "Kissinger's death and the opportunity it presents for obtaining these long-sought-after records are the very definition of a breaking news story which concerns a matter of current exigency to the public. Furthermore, the [cited] reasons clearly demonstrate that this is a matter of widespread and exceptional media interest in which there exist possible questions about the government's integrity which affect public confidence." The FBI acknowledged receipt of the request and told Rolling Stone that responsive records would be posted to the FBI's electronic FOIA library. The FBI then denied Rolling Stone's request for expediting processing, indicating that while Rolling Stone had properly explained that it was a member of the news media, urgently seeking records to inform the public, on a matter of widespread and exceptional media interest regarding possible questions about government integrity, Rolling Stone "had not provided enough information concerning the statutory requirement for expedition, therefore, your request is denied." The Rolling Stone request was one of 16 requests for records about Kissinger and the FBI had identified 7,900 responsive records, importing 6,000 potentially responsive pages to the FBI's electronic library. The FBI made its first interim response, at a rate of 500 pages a month, to Rolling Stone, reviewing 506 pages and releasing 392 pages in full or in part. Rolling Stone filed suit against the FBI, arguing that the agency had improperly denied its request for expedited processing because, first, it is a person primarily engaged in disseminating information and the request concerns and urgency to inform the public concerning actual or alleged Federal Government activity and, second, the matter is one of widespread and exceptional media interest in which there exist possible questions about the government's integrity that affect public confidence. However, Judge Lewis Liman observed that "plaintiff has not satisfied its burden of proof on either ground." He noted that "because DOJ's resources are not unlimited and because expedition is a relative exercise, the determination of whether there is a compelling need for expedition is to some extent a zero-sum exercise. If one request is accorded expedited treatment, other requests may not be accorded expedited treatment." Liman indicated that "there is no dispute that Rolling Stone, as the publisher of a well-known and widely distributed magazine, is a person 'primarily engaged in disseminating information.' There also is no dispute that the activities of Kissinger and those of the FBI in conducting its investigations relate to actual or alleged Federal Government activity." However, Liman pointed out that "plaintiff has not established based on evidence before the agency that its request concerns a matter of current exigency to the American public or that the consequence of delaying a response would compromise a significant recognized interest. Kissinger passed away in November 2023. There is no question that his activities in government are of historical and public interest." Liman noted that "but the historical value of information regarding Kissinger is not alone enough to establish that the request concerns a matter of current exigency." Liman explained that courts had interpreted current exigency as referring to a current pressing issue. In that regard, he noted that "plaintiff's request is indiscriminate. It calls for all documents concerning Kissinger during that entire time period." Liman indicated that "the burden is on Plaintiff to justify expedited processing, and Plaintiff has failed to identify any specific subject relative to Kissinger's six-decade career that the requested records relate to that is of current exigency to the American public." Finding that Rolling Stone had not shown the records generally were a matter of widespread and exceptional media interest, Liman indicated that "it is not sufficient that the request concerns an individual as to whom there is widespread and exceptional media interest if the subject as to which there is public interest is not one that also raises questions about the government's integrity." Liman observed that Rolling Stone "did not show that his death (or any other subject that could have attracted widespread and exceptional media interest) raised questions about the government's integrity."
