2024-07-31 | 11 | PAPERLESS ORDER on Motion for Extension of Time. THIS CAUSE is before the Court on Defendant's Unopposed Motion for 45-Day Enlargement of Response Deadline (the "Motion"), ECF No. 10 . In the Motion, Defendant requests an "enlargement from the current deadline of August 1, 2024," to a new "deadline of Monday, September 16, 2024." See ECF No. 10 at 1. Defendant asserts that a 45-day extension "is appropriate because of the rapidly evolving nature of the proceedings and because of the high likelihood that this matter will be resolved without further litigation, thereby preserving resources." See ECF No. 10 at 1. Defendant also notes that "Plaintiff does not oppose this Motion." See ECF No. 10 at 1. Although it is not the Court's usual practice to grant 45-day extensions to response deadlines, the Court finds good cause to do so in this case. As the Motion explains, the case relates to a FOIA request that can be satisfied once the Clerk of Court releases copies of certain exhibits from an earlier criminal case, which can be accomplished by an order from a District Judge of this Court. See ECF No. 10 at 2-4. To allow time for the Parties to request that relief and for the District Judge in that case to rule on the request, the Motion, ECF No. 10 , is GRANTED . Defendant shall have until September 16, 2024 to file a response to Plaintiff's Complaint. Signed by Magistrate Judge Marty Fulgueira Elfenbein on 7/31/2024. (MFE) (Entered: 07/31/2024) |
2024-09-05 | 12 | NOTICE of Voluntary Dismissal Notice of Voluntary Dismissal Without Prejudice by Estes Express Lines (Golden, John) (Entered: 09/05/2024) |
2024-09-12 | 13 | PAPERLESS ORDER. THIS CAUSE came before the Court upon Plaintiff's Notice of Voluntary Dismissal. 12 . Rule 41(a)(1)(A) of the Federal Rules of Civil Procedure allows a plaintiff to voluntarily dismiss a claim prior to a defendant's filing of an answer or a motion for summary judgment, or after an answer has been filed where the dismissal bears the signatures of both parties. Fed. R. Civ. P. 41(a)(1)(A)(i). In this case, neither an answer nor a motion for summary judgment has been filed. Accordingly, UPON CONSIDERATION of the Notice, the pertinent portions of the record, and being otherwise fully advised in the premises, it is ORDERED AND ADJUDGED that the above-styled cause is hereby DISMISSED WITHOUT PREJUDICE. The Clerk of Court is instructed to CLOSE this case. All pending motions, if any, are DENIED AS MOOT. Signed by Judge K. Michael Moore on 9/12/2024. (gbn) (Entered: 09/12/2024) |
