2024-08-15 | | MINUTE ORDER. Upon consideration of Defendant's 5 Motion for Extension of Time to File Response to Complaint and Plaintiff's 6 Opposition to Motion for Extension of Time, the Court hereby GRANTS the Motion and ORDERS Defendant to respond to Plaintiff's 1 Complaint on or before September 16, 2024. The Motion sets forth good cause for an extension to allow Defendant's counsel to confer with agency staff, and the Opposition does not explain how an extension would meaningfully prejudice Plaintiff. The Court expects parties to cooperate professionally in scheduling matters; opposing a request for an extension of time absent any prejudice does not meet that standard. That said, the Court will look on any further extension request with disfavor and expects Defendant to comply with the 4 Standing Order's rules and deadlines - including the requirement that extension motions be filed at least four days in advance of the relevant deadline - moving forward. SO ORDERED. Signed by Judge Ana C. Reyes on 08/15/2024. (lcacr2) (Entered: 08/15/2024) |

2024-09-19 | | MINUTE ORDER. Plaintiff filed this Freedom of Information Act (FOIA) action on July 14, 2024. Dkt. 1 . Defendant answered on September 16, 2024. Dkt. 7 . Cases filed under FOIA are exempt from the requirements of Federal Rule of Civil Procedure 26(f) and Local Civil Rule 16.3. See LCvR 16.3(b)(10). Accordingly, the Court hereby ORDERS the parties to meet and confer and file a joint status report on or before October 3, 2024. The joint status report should address, among other things, (1) the status of Plaintiff's FOIA requests; (2) the anticipated number of documents responsive to Plaintiff's FOIA requests; (3) the anticipated date(s) for release of those documents; and (4) whether a motion for a stay under Open America v. Watergate Special Prosecution Force , 547 F.2d 605 (D.C. Cir. 1976), is likely. As set forth in Section 5(d) of the Court's 4 Standing Order, if the parties agree on a proposed schedule for submitting a further joint status report, they should assume that the Court approves the proposed date unless the Court enters an order to the contrary. Counsel shall not contact Chambers directly concerning scheduling or other matters, as Chambers personnel will not handle questions relating to the status or scheduling of pending matters, except in case of an emergency. In an emergency, Chambers can be reached at (202) 354-3350. Signed by Judge Ana C. Reyes on 09/19/2024. (lcacr2) (Entered: 09/19/2024) |
