2024-08-05 | 6 | Magistrate Judge Paul G. Levenson: ELECTRONIC ORDER entered denying (without prejudice) 2 Motion for Leave to Proceed in forma pauperis. Plaintiffs Affidavit of Indigency (ECF No. 2 ) is construed as a motion to proceed in forma pauperis pursuant to 28 U.S.C. 1915(a). As such, that motion is DENIED without prejudice. Pursuant to the statute, any court of the United States may authorize the commencement, prosecution or defense of any suit, action or proceeding, civil or criminal, or appeal therein, without prepayment of fees or security therefor, by a person who submits an affidavit that includes a statement of all assets such [person] possesses [and] that the person is unable to pay such fees or give security therefor. Such affidavit shall state the nature of the action, defense or appeal and affiant's belief that the person is entitled to redress. 28 U.S.C. 1915(a). Here, the Affidavit of Indigency is on a state court form that does not include all information required under Section 1915. If submitting an application to proceed without prepaying fees or costs, Plaintiff should use Form AO240, which is readily available on-line. Plaintiff shall by August 26, 2024, either pay the $405 filing and administrative fee or file a renewed and complete motion for leave to proceed in forma pauperis. If no such filing is made, this action will be dismissed without prejudice. The Plaintiff is ordered to file a copy of the December 3, 2023, FOIA request that is referenced in the complaint, along with any responses that Plaintiff may have received from the federal agency. If the Plaintiff does not have copies of the letter and/or responses, Plaintiff shall inform the Court by filing a status report. In his Complaint, Plaintiff requests appointment of counsel, citing 5 U.S.C. 552(a)(4)(B), which does not address appointment of counsel. Treating this as a request for appointment of pro bono counsel under 28 U.S.C. 1915(e), the request is DENIED without prejudice.
