FOIA Project Annotation: Judge Rosemary Collyer has dismissed Ljubica Rajkovic's FOIA suit after finding that Rajkovic failed to respond to the FBI's offer to provide her administrative records related to the processing of her FOIA request for records of alleged surveillance of her. Rajkovic, a Serbian citizen, requested records about the alleged surveillance, but never responded to the agency's offer to disclose the administrative records. After the sixty days in which to appeal the agency's denial expired, Rajkovic filed a motion of appeal, which Collyer then denied. Collyer noted that "the time limit for filing an appeal is mandatory and jurisdictional." She concluded that "because the Court lacks jurisdiction to grant Ms. Rajkovic's untimely motion to reopen the time for appeal, her motion will be denied."
