FOIA Project Annotation: Attempting to resolve the remaining issues in a FOIA suit brought on behalf of six Guantanamo detainees, the court, noting that only one detainee remained incarcerated, ruled that the Defense Department had properly withheld a chain of emails under Exemption 7 (law enforcement records). The court indicated those emails had been produced to the attorneys representing the six detainees as part of the habeas corpus proceedings before Judge Richard Leon in U.S. District Court for the District of Columbia and were still subject to a protective order. The court had asked plaintiffs to identify any further disputed documents. However, the court rejected plaintiffs' claim that many documents still were not adequately identified as being akin to a fishing expedition. Instead, the court ordered DOD to provide a Vaughn index of specific disciplinary records.

2012-07-03ELECTRONIC NOTICE Setting Ex parte Hearing with Department of Defense on its ex parte response to court. Ex parte hearing set for 7/6/2012 - 4:00 PM in Courtroom 21 before Judge Richard G. Stearns to seek clarification regarding classification of certain documents submitted for in camera review. While uncomfortable with the use of ex parte proceedings, as it may appear to be contrary to the fundamental nature of the adversary process, however, this court believes, as did the court in Arieff v. U.S. Dep't of the Navy, 712 F.2d 1462, 1469 (D.C. Cir. 1983) and Patterson by Patterson v. F.B.I., 893 F.2d 595 (3d Cir. 1990), that an ex parte proceeding is necessary "to determine whether the documents were privileged without destroying the very privilege that the Court was charged with protecting, if applicable." Pack v. Beyer, 157 F.R.D. 226, 230 (D.N.J. 1994). The court will ensure that a full record is kept of the proceeding as "an essential safeguard to protect Plaintiffs' interests." See United States v. The court issued its September 25, 2012 Order, and subsequent Notice of Hearing with the understanding that Oleskey and one or more of his counsel had the security clearances necessary for an in camera hearing with access to the remaining disputed documents. Now the court is informed that Oleskey and his counsel's security clearances are case specific and do not extend to the FOIA case. Consequently, the hearing serves no purpose.
