FOIA Project Annotation: In a technology dispute that raises issues that have not been the subject of much litigation so far, a federal court in California has moved a step closer to resolving whether a database file maintained on the website of the Defense Logistics Agency actually is technically responsive to Richard Snyder's request. Snyder, who worked for Total Procurement Systems, Inc, which provides government procurement information to third parties, requested the agency's Business Systems Modernization data and its Total Item Record data. DLA told Snyder that both records were available on the agency's website, but once Snyder received them he complained that they were incomplete or corrupted. Over the government's objections, the court appointed a trial master to sort out the technical problems. In his September 2005 report, the trial master told the court that the government had been uncooperative and "less than forthcoming" in its responses. In the current ruling, Judge Vaughn Walker reviewed the trial master's second report and rejected the agency's claim that to comply with the master's findings would require "unjustifiable time and cost." Walker noted that "absent exceptional circumstances, release of information is required unless it falls under one of nine statutory exemptions. Needless to say, the prospect of compliance expenses is not one of those exceptions, especially considering the average cost per request approached $1,000 in 2006." He observed that "the government may assess costs after providing the relevant agency records. Yet these procedures do not absolve the government of its duty to comply with plaintiff's request." Pointing out that "the parties have displayed a marked unwillingness to cooperate in this dispute," Walker indicated that he would retain "broad discretion to establish a remedy in accordance with fairness and efficiency."

FOIA Project Annotation: A federal court in California has ruled that Richard Snyder has failed to show that the Defense Department can provide him data on solicitations over $100,000 without creating a new software program to extract the data requested. Snyder refused to pay the estimated $5400 to create the software. A technical expert appointed by the court agreed with Snyder that the data should be extractable with existing database software, but was unable to resolve the issue. But in tying up loose ends in the case, the court pointed out that "the trial master's statements that he did not comprehend defendants' assertion that a new software program is necessary do not amount to a reasonable denial of defendants' position." The court noted that "it appears that compliance with plaintiff's request requires an extraction of data that defendants are unable to accomplish absent the preparation of new software. Plaintiff thus appears to have the choice of tendering the funds necessary to do so or foregoing the extracted data. Having failed to offer to pay for the cost of the extraction software, summary judgment for defendants appears in order."
