2013-05-31MERIT REVIEW SCHEDULING ORDER: This case is set for a merit review hearing. The court is required by 28 U.S.C. Section 1915A to review the plaintiff's complaint, and through such process to identify and dismiss any legally insufficient claim, or the entire action if warranted. A claim is legally insufficient if it "(1) is frivolous, malicious, or fails to state a claim upon which relief may be granted; or (2) seeks monetary relief from a defendant who is immune from such relief." The plaintiff must be prepared to identify each of his claims against each of the defendants during the hearing. The hearing may be cancelled if the Court determines the hearing is unnecessary. Therefore, no writ shall be issued to secure Plaintiff's presence at the hearing until further order of this Court. The merit review hearing is set before Judge Sue E. 2013-06-27ORDER granting 2 Petition to Proceed In Forma Pauperis. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $3.54. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff's account to the Clerk of Court. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff is directed to make monthly payments of 20 percent of the preceding month's income credited to Plaintiff's account to the Clerk of Court. 2013-10-08TEXT ORDER: Plaintiff seeks to compel Defendants to disclose an Illinois Administrative directive pursuant to the Illinois Freedom of Information Act. Plaintiff alleges that he has successfully pursued his rights under that Act and that Defendants are refusing to comply. Plaintiff may state a claim under Illinois law, but he does not state a claim under federal law. Plaintiff must follow the procedures under the Illinois Freedom of Information Act. If court action is Plaintiff's next step, Plaintiff needs to file his claim in state court, not federal court. Accordingly, this case is dismissed for lack of federal jurisdiction, without prejudice to Plaintiff's pursuit of his state court remedies.
