FOIA Project Annotation: A federal court in New York has accepted a magistrate's recommendation finding that the Treasury Department did not improperly assess fees for searching for records responsive to Daniel Lorber's requests under FOIA instead of the Privacy Act. Lorber's requests would have required the agency to search more than 750,000 emails. The agency assessed fees for the searches, but Lorber argued that the cost of the searches could not be assessed to him because he had made his request under the Privacy Act as well. Rejecting the claim, the court noted that "the Privacy Act does not apply to Plaintiff's requests. Plaintiff's requests do not fall within the scope of the Privacy Act because Plaintiff's requests are not about Plaintiff, but relate to whether Defendant's hiring practices reference Plaintiff. Furthermore, there is no evidence that the emails at issue are part of the 'system of records' because the emails are kept in separate offices, rather than in any filing system that is retrievable and indexed under an identifier such as Plaintiff's name."

2016-02-02SCHEDULING ORDER: On or before 2/9/2016, each party is to provide the Court with a supplemental brief of no more than three pages providing the Privacy Act-related legal authority for Plaintiff to be provided with the emails identified in his FOIA request (categories 1 through 7) without paying search fees. Unlike FOIA, disclosure is not the primary goal of the Privacy Act, Blazy v. Tenet , 194 F.3d 90, 96 (D.C. Cir. 1999), but rather its purpose is to "safeguard[] the public from unwarranted collection, maintenance, use and dissemination of personal information contained in agency records," Bartel v. F.A.A. , 725 F.2d 1403, 1407 (D.C. Cir. 1984). Moreover, the Privacy Act does not permit a government agency to assess fees for searching for records. 26 C.F.R. § 601.702(f)(3)(iv)(C). The only fees that the agency is permitted to collect are duplication fees for copying records after the first 100 pages of records. Id. A final distinction is that, "while [ ] FOIA permits 'any person' to seek access to any 'agency record,'... the Privacy Act permits only 'an individual' to seek access to only his or her own record, and only if that record is maintained by that agency within a 'system of records.'" Lane , 2006 WL 1455459, at *5. Only "records" retrieved from a "systems of records" are subject to the Privacy Act. Walia v. Napolitano , 986 F. Supp. 2d 169, 186 (E.D.N.Y. 2013). A "record," under the Privacy Act, is defined as: any item, collection, or grouping of information about an individual that is maintained by an agency, including, but not limited to, his education, financial transactions, medical history, and criminal or employment history and that contains his name, or the identifying number, symbol, or other identifying particular assigned to the individual, such as a finger or voice print or a photograph. 5 U.S.C. § 552a(a)(4). A "system of records" is defined as, "a group of any records under the control of any agency from which information is retrieved by the name of the individual or by some identifying number, symbol, or other identifying particular assigned to the individual." 5 U.S.C. § 552a(a)(5). Each agency that establishes a new "system of records" must publish notice of such establishment in the Federal Register. 5 U.S.C. § 552a(e)(4). As described in the Second Circuit decision, Bechhoefer v. U.S. Dep't of Justice , 312 F.3d 563, 566 (2d Cir. 2002), the definition of "system of records" limits the applicability of the Privacy Act to: "[R]ecords" which are maintained by an agency, retrieved by individual identifier[s] (i.e., there is an indexing or retrieval capability using identifying particulars built into the system), and the agency does, in fact, retrieve records about individuals by reference to some personal identifier. The phrase "under the control of the agency" was intended to accomplish two separate purposes: (1) to determine possession and establish accountability; and (2) to separate agency records from records which are maintained personally by employees of an agency but which are not agency records .... It is only when the document becomes incorporated into a record-keeping system under the agencys control that the [Privacy] Act's prescriptions apply. Id. (emphasis in original). Thus, "a group of records should generally not be considered a system of records unless there is actual retrieval of records keyed to individuals." Henke v. U.S. Dept of Commerce , 83 F.3d 1453, 1460 (D.C. Cir. 1996). Simply "because an agency is capable of retrieving the information, and just because it does so to comply with a FOIA request, does not mean that the information is maintained in a Privacy Act 'system of records.'" Yonemoto v. Dep't of Veterans Affairs , 06 Civ. 00378 (BMK), 2007 WL 1310165, at *6 (D. Haw. May 2, 2007) dismissed and remanded , 305 F. App'x 333 (9th Cir. 2008). Several district courts have analyzed whether government agency email archives qualify as a "system of records" under the Privacy Act. These courts have held that, although the email archives may be searchable by a person's name, they did not qualify as a "system of records," either because the email archives were not indexed by a personal identifier or because the email archives were never noticed as a "system of records" in the Federal Register. See, e.g. , Thompson v. United States Dep't of Justice, Criminal Div. , 14 Civ. 1786 (JEB), 2015 WL 7303519, at *6 (D.D.C. Nov. 19, 2015) (Department of Justice email archive is not a "system of records" covered under the Privacy Act); Gordon v. Courter , 14 Civ. 1382 (CKK), 2015 WL 4602588, at *9 (D.D.C. July 31, 2015) (same); Mobley v. C.I.A. , 924 F. Supp. 2d 24, 56 (D.D.C. 2013) aff'd , 806 F.3d 568 (D.C. Cir. 2015) (holding that a database of email is not a "system of records" because the emails are not indexed by a personal identifier); Krieger v. U.S. Dep't of Justice , 529 F.Supp.2d 29, 42-43 (D.D.C. 2008) (holding that e-mails were not part of "system of records" under Privacy Act where plaintiff "offer[ed] no facts suggesting that [records] would have been indexed by name, or that an electronic folder existed that grouped emails related to him by name or other identifier"); Yonemoto , 2007 WL 1310165, at *6 (Department of Veterans Affairs ("VA") email archives were not a "system of records" under the Privacy Act because the VA did not provide notice of a system in the Federal Register); Rivera v. Potter , 400 F. Supp. 2d 404, 410 (D.P.R. 2005) (no indication that printouts of emails found at United States Postal Service facility were maintained in a "system of records" as covered under the Privacy Act because they were not retrievable under the plaintiff's name or filed in a system under an identifier attributed to plaintiff). Magistrate Judge Scanlon recommended that the Court deny Plaintiffs Motion and grant Defendant's Motion. For the following reasons, the Court ADOPTS Magistrate Judge Scanlon's Report and Recommendation in its entirety.
