2014-02-216ORDER: Karl W. Fields has submitted a complaint and a motion for leave to proceed without prepayment of fees ("in forma pauperis petition"). Mr. Fields has a modest income, but substantial debt. The court concludes that he is capable of paying a reduced fee and will direct that he submit a payment of $100, if this case goes forward. The complaint Mr. Fields has submitted does not state a claim arising within this court's jurisdiction. As the court understands his claim, Plaintiff owns a condominium in the Windwood development managed by R Y Properties. He alleges that R Y has mismanaged the condominium and violated the condo association's bylaws by failing to provide notice of association meetings; failing to provide an annual budget; and failing to provide appropriate maintenance and repair services. Such a claim appears to arise under state contract and/or property law. It appears that R Y Properties is located in Lansing, Illinois (see http://www.ryproperties.net/, last visited February 21, 2014), and Mr. Fields resides in Richton Park, IL. As both Plaintiff and Defendant are Illinois citizens, the court has no jurisdiction to adjudicate a state law dispute between them. The complaint is, therefore, dismissed without prejudice. Mr. Fields is invited to file an amended complaint if he can state a claim that arises under federal law, or, in the alternative, if he can show that all of the Defendants are in fact citizens of states other than Illinois and at least $75,000 is at stake. The amended complaint, if any, should be submitted within 30 days. Pending receipt of such an amended complaint, the motion for leave to proceed without prepayment 4 and the motion for attorney representation 5 will be held in abeyance.
