Case DescriptionJulio Cardenas, a prisoner, submitted a FOIA request to the U.S. Marshals Service for records concerning his confinement. The agency told Cardenas if such records existed they would be withheld under Exemption 7(C) (invasion of privacy concerning law enforcement records) and the Privacy Act. Cardenas filed an appeal with OIP. OIP declined to rule on the appeal because USMS had not made an adverse determination. The case was then sent back to USMS, which told Cardenas it was conducting a search. After hearing nothing further, Cardenas filed suit.
