2016-05-0226Magistrate Judge Jennifer C. Boal: ELECTRONIC ORDER DENYING WITHOUT PREJUDICE 25 Second Motion to Compel. The Court deems plaintiff's April 14, 2016 email to Attorney Poteau a request for production of documents under Rule 34 of the Federal Rules of Civil Procedure. However, the plaintiff's motion to compel is premature. Under Rule 34, defendant has 30 days to respond to a request for production of documents. As such, defendant's response would be due May 16, 2016. Accordingly, the Court denies the motion without prejudice. (York, Steve) (Entered: 05/02/2016)
2016-05-0927Magistrate Judge Jennifer C. Boal: ELECTRONIC ORDER DENYING WITHOUT PREJUDICE 21 Motion to Amend. Plaintiff moves to amend his complaint to add two new parties. Local Rule 15.1 requires a plaintiff seeking to amend his complaint to add a new party to serve the motion to amend on the proposed new party at least 14 days in advance of filing the motion, together with a separate document stating the date on which the motion will be filed. L.R. 15.1(b). A motion to amend the complaint must also contain a certificate stating that the motion was served in advance on the new proposed party as required by the rule. Id. Plaintiff has not complied with Local Rule 15.1. Accordingly, the motion to amend the complaint is denied without prejudice. (York, Steve) (Entered: 05/09/2016)

2016-06-1330Magistrate Judge Jennifer C. Boal: ELECTRONIC ORDER DENYING 29 Motion to Continue Proceedings. In essence, plaintiff seeks a stay of proceedings in this case for one year because he does not have the resources to properly litigate this case at this time. Plaintiff filed this action and is responsible for prosecuting it. Staying the litigation for a year would result in an undue delay. Accordingly, the Court denies the motion.
