Case DescriptionRichard Angell, an attorney representing Noranda Mining in litigation concerning a Superfund clean-up, submitted a FOIA request to the Department of Justice for records concerning communications between the agency and Asarco and other responsible third parties pertaining to the clean-up. The agency withheld 28 documents in full, claiming they were part of a dispute resolution arbitration. Angell filed an administrative appeal, which was denied. Angell and Noranda Mining then filed suit.
