Case DescriptionJoel Brodsky submitted a FOIA request to the FBI for records concerning himself, including his work as a confidential informant. The agency acknowledged receipt of the request. The agency told Brodsky that it found no responsive records. Brodsky filed an administrative appeal and the Office of Information Policy remanded the case for searching. Brodsky was contacted by a special agent to discuss his role as a confidential source. However, after the agency failed to respond, Brodsky filed suit.

The Court had posed some questions to the government at the last hearing to determine whether there was a potential recusal issue here. Today, the government provided information that revealed the undersigned magistrate judge had personal knowledge and involvement in some of the events described in the documents at issue when he was as an Assistant United States Attorney and prior to assuming the bench. Canon 3(C)(1) of the Code of Conduct for United States Judges requires mandatory disqualification and recusal when a judge has personal knowledge of disputed evidentiary facts or has previously served as a lawyer in the matter in controversy. While the parties graciously waived any recusal issues on the record and the Court commented that those documents mentioned above could be walled-off for now, the Court's further research after the hearing reveals that this form of disqualification cannot be waived. See Canon 3(D). As a result of mandatory recusal, the undersigned magistrate judge cannot remain on the case. 2023-07-2136MINUTE entry before the Honorable Sharon Johnson Coleman: Status hearing held 7/21/2023. On 4/19/23, Plaintiff Brodsky moved for in camera inspection of the undisclosed documents at issue in this case. Brodsky represented that the documents contained information relating to statements he made as a confidential informant. Therefore, he argued that an in-camera review would expedite resolution of this case. It now appears that the 500+ documents could include other information relating to Brodsky's legal representation of prior clients. Based on this information, the Court determines that a Vaughn Index is the appropriate first step to delineate between the types of documents at issue and the FBI's claimed exemptions. As stated on the record, the Court remains open to conducting an in-camera review on a small selection of documents, should the Vaughn Index show that they only involve the confidentiality of Brodsky's identity or cannot otherwise be resolved based on the Vaughn Index alone. The parties shall confer about the best procedure and timing for the Court's review of the Vaughn Index and submit a joint status report with their proposals by 08/31/2023. Judge Coleman has ordered that I was to review and the Government was to turn over "the Vaughn index as well as the documents the Government believes are exempt under FOIA in keeping with settlement negotiations." Those are the documents that are to be turned over and my Order 46 did not or at least was not intended to expand or abridge the materials that Judge Coleman required be submitted to me. Her Order went on to say that "Obviously, the negotiations will require conversations or explanations as to Plaintiff Brodsky's reasons and objectives for seeking the information and the FBI's reasons for withholding the information from him." As of now, the Government has not said it was unwilling to turn over the materials that were sought and that Judge Coleman ordered and assumed would be provided by the Government. There will be time enough to deal with any holdbacks the Government claims are warranted and authorized, but that has not yet happened. 2023-10-1751MINUTE entry before the Honorable Jeffrey Cole: In-Court hearing held regarding the Government's in-camera submission of the Vaughn Index and related documents. In an extended, in-court conference with Mr. Brodsky and Mr. Haile, counsel for the Government, it became apparent that a settlement of this case was not feasible. Mr. Brodsky explained why he wanted and needed the materials sought in his lawsuit against the FBI (22cv6462), and why, in his view, no subset of the materials sought would suffice. This all or nothing view of the matter was shared by the Government. In its view, Mr. Brodsky was not entitled to the materials sought in his suit, and in any event, it would not agree to providing some smaller subset of materials sought by the suit. Even when Mr. Brodsky was asked directly whether anything short of all the materials being requested would be sufficient, he responded that it would not, and that he needed, for reasons he explained, all the materials being sought by his suit. The materials examined in-camera were returned after the hearing to the Government.
