Case DescriptionFreedom Coalition of Doctors for Choice submitted a FOOIA request to the Centers for Disease Control for records concerning data obtained from v-safe user/registrants from the free text field within the v-safe program for COVID-19 vaccines. The Coalition also requested expedited processing. The agency acknowledged receipt of the request. The agency told the Coalition that it was too burdensome to respond to its request. The Coalition filed an administrative appeal. After hearing nothing further the Coalition filed suit.

2023-11-0323ORDER: Defendants' Motion to Dismiss for improper venue is DENIED because the Court finds that Plaintiff has carried its burden to establish that its principal place of business, indeed its only place of business, is in Amarillo, Texas. Defendants' Rule 56 Motion is DENIED, insofar as it moves the Court to deny or defer consideration of Plaintiff's Summary Judgment Motion as premature or to conduct discovery, because the Court has determined venue is proper.
