Order Clerk Mark M. Busby to appear as a defendant and require witness James Santillana of Western Attorney Services to testify as to what was delivered to the clerks and Judges drop box and what was returned, to clarify the chain of custody and ensure the integrity of the record. Direct the Clerks office to produce an accurate and complete record of all evidence delivered, docketed, and returned, including all USB drives, original summons, complaints, and supporting materials, prior to the rescheduled hearing, as required by the Federal Rules of Civil Procedure and Local Rules. Require the Clerk to sign and issue all summons for service on Defendants without further delay, as mandated by 28 U.S.C. § 751 and the Federal Rules of Civil Procedure. Appoint counsel under 28 U.S.C. § 1915(e)(1) and a master under Federal Rule of Civil Procedure 53 to oversee the management and docketing of all filings and evidence, ensuring judicial receipt and due process. Impose sanctions against the Clerk and responsible officials in the amount of $1,500 per day for obstruction, abuse of process, and failure to respond, as authorized by Federal Rules of Civil Procedure 37 and 11, in light of the repeated violations of procedural rules, refusal to docket evidence, and unauthorized changes to hearing dates without judicial order or proper notice. Order the Clerks to cite the specific rule or law justifying their action. Order administrative relief under Civil L.R. 7-11 and clarification from the assigned Judge. Escalation to the Judge for review of the clerks conduct and provide a ruling or explanation. WIW 3:2024cv00490 2025-10-24 28 ** TEXT ONLY ORDER ** The government has requested to stay some civil cases to which it is a party, including this one, citing a lapse in funding that has impeded its ability to litigate the cases. Courts have broad discretion to stay cases to manage their dockets and promote efficiency. Landis v. N. Am. Co. , 299 U.S. 248, 254 (1936). In deciding whether to impose a stay, the court must balance those interests favoring a stay against those interests frustrated by the action. Feed.Ing BV v. Principle Sols. , LLC, No. 14-cv-1241, 2015 WL 13158324, at *1 (E.D. Wis. Apr. 21, 2015). Here, the court is charged with seeing this case to a just and speedy resolution. See Fed. R. Civ. P. 1. A just resolution requires that both sides have an opportunity to fully participate in and litigate the case, so a stay under the current circumstances is warranted. But a stay also means some delay. At this point, it is not clear how long the lapse in funding will last. All things considered, the balance of the interests weighs in favor of granting the stay, but that may change as time goes on, and the opposing party may seek to lift the stay should the balance of interests change. For now, the stay will remain in place until the lapsed funding is restored. Within seven days of the restoration of funding, the parties must submit a joint proposed order to reset the schedule, calculating the new case deadlines by adding the elapsed time to the original schedule.
