DC 1:2013cv00555 2020-12-02 MINUTE ORDER: In their cross-motion for summary judgment, Plaintiffs challenge the withholding of Form 0-63 records. Dkt. 143 at 27. Plaintiffs explain that they are "unable to determine precisely how many pages of 0-63 records remain at issue and request that the Court order the FBI to provide a full accounting of these records." Id. at 3. The FBI argues that these forms were properly withheld pursuant to the Court's holding in Shapiro IV approving the FBI's withholding of search slips related to parent FOIA requests that resulted in No Records responses. Dkt. 148 at 3-5; Shapiro v. United States Dep't of Justice , 239 F. Supp. 3d 100, 116 (D.D.C. 2017) (" Shapiro IV "). But that case-specific holding in Shapiro IV was limited to parent requests from Ryan Shapiro, not parent requests from other Plaintiffs or third-parties. Id. at 113 ("Rather than asserting a blanket policy applicable to all search slips and FOIA processing notes generated in response to requests for investigative records or files over the past twenty-five years, the FBI asserts a case-specific exemption applicable to only the... 'No Records' responses to the... 'parent' FOIA requests submitted by Ryan Shapiro ") (emphasis added). Based on the Court's understanding, there are now twenty-nine No Records parent requests from Shapiro at issue in the case, following the FBI's determination that thirteen of Shapiro's parent requests that it had previously counted as No Records were in fact Non-No Records. See Dkt. 132-1 at 5. It is unclear from the parties' briefing, however, whether the Form 0-63 records that the FBI is still withholding relate to Shapiro's No Records parent requests or No Records parent requests from others. Because the Court's holding in Shapiro IV , on which the FBI relies, was applicable only to the former, it is hereby ORDERED that the FBI shall file a notice with the Court, on or before 3 p.m. on December 4, 2020, indicating how many Form 0-63 records it is withholding from Plaintiffs and, of those records, how many of them relate to parent No Records requests from Ryan Shapiro and how many, if any, relate to parent No Records requests from others.
