    • March 31, 2018: MEMORANDUM & ORDER granting [115] Motion for Summary Judgment. SO ORDERED that Defendants' motion for summary judgment (Docket Entry 115) is GRANTED. To the extent Plaintiff seeks the first page of the April 1990 Document from the CIA, that cla im is DISMISSED WITH PREJUDICE. Plaintiff's remaining claims relating to the DOJ Request and the portion of the CIA request seeking documents withheld by the CIA pursuant to FOIA Exemption 3 are DISMISSED WITHOUT PREJUDICE. The Court notes that Plaintiff is required to obtain leave from Judge Garaufis before filing any future FOIA complaints. See Robert v. Dep't of Justice, 439 Fed. App'x at 34-35 (Here, the District Court [Judge Garaufis] did not err or abuse [his] discretion in enjoining Robert from filing further complaints raising FOIA claims without leave of the court, given Robert's history of filing vexatious, burdensome, and meritless FOIA complaints.). The Clerk of the Court is directed to enter judgment accordingly, mark this case CLOSED, and mail a copy of this Memorandum and Order to the pro se Plaintiff. For the reasons stated above, the State Depart ment's motion for summary judgment is GRANTED IN PART and DENIED IN PART without prejudice. Mr. Seife's cross-motion is DENIED. The denial of the Mr. Seife's motion is without prejudice to the extent that the motion challenges the State Department's response to the 12997 request, the withholding of documents and information under Exemption 5, and the withholding of the identities of the background briefers under Exemption 6. The State Department is directed to s ubmit revised Vaughn submissions addressing the State Department's response to the 12997 request, the information and document claimed exempt under Exemption 5, the identities of background briefers claimed exempt under Exemption 6, as w ell as a segregability analysis addressing the Category 15 document, along with a renewed motion for partial summary judgment no later than April 30, 2018. Mr. Seife may file a renewed cross-motion for summary judgment with respect to the State Department's response to the 12997 request and its withholding of information and documents under Exemptions 5 and 6 no later than thirty (30) days from the date of service of the State Department's renewed motion. Any oppositions to the motion(s) for summary judgment are due no later than twenty-one (21) days following service of the motions, and any replies are due no later than fourteen (14) days following service of the oppositions. The motion by the Defendant Central Intelligence Agency for summary judgment dismissing Plaintiff's complaint under the Freedom of Information Act (FOIA), 5 U.S.C. § 552 (1988), is GRANTED. The cross motion for summary judgment filed by Plaintiff is correspondingly DENIED. The Clerk is directed to remove the motions at Dockets# 16 and 21, from the Court's list of open motions. Docket #32 is erroneously docketed as a & quot;Supplemental Motion," when it is in fact a "supplemental brief;" it is the Plaintiff's reply papers in support of its motion and in opposition to the Government's motion. Therefore, Docket #32 should be removed from th e Court's list of open motions. Finally, the court has already granted the consent motion by Amici to file a brief in this matter, so the motion at Docket #31 should be closed and removed from the Court's open motion list.
