2012-04-04 | | MINUTE ORDER Plaintiff opposes the stay on the grounds that the FBI has not established the four factors needed for a stay, but it also states that the FBI is obliged to move to certify the issues for an interlocutory appeal under 28 U.S.C. 1292(b) within a certain time frame. In reply, the FBI cites Ctr. for Nat'l Sec. Studies v. CIA, 711 F. 2d 409, 413 (D.C. Cir. 1983) for the proposition that this is not an interlocutory appeal under 28 U.S.C 1292(b) that the Court must certify, this is an order tantamount to a ruling on an injunction under 28 U.S.C. 1292(a), which is immediately appealable without certification. Because plaintiff has not had the opportunity to address that narrow issue, the Court directs plaintiff to submit a brief of no more than five pages by April 13, 2012 on the question of whether the Court's order of January 31, 2012 is immediately appealable under section 1292(a) and the law set forth in Ctr. of Nat'l Sec. Studies. If defendant wishes to supplement (without repeating) what it has already provided to the Court on this issue, it may do so in no more than five pages by the same date. While the Court could treat the motion as conceded under LCvR 7(b) because the FBI failed to oppose the motion within 14 days, it will address the matter on the merits. The Court finds that the FBI's Second Argall Declaration which serves as its Vaughn index [Dkt. # 44-1] fails to comply with the Court's January 31 and April 4, 2012 Orders. In particular, the Court ordered the FBI to "review the file if it exists and then either produce the responsive documents or provide a Vaughn index identifying the specific exemptions under which any responsive documents have been withheld." Mem. Op. on Jan. 31, 2012 at 23, citing Benavides v. DEA, 968 F.2d 1243, 1246 (D.C. Cir. 1993) ("[W]e conclude that when an informant's status has been officially confirmed, the requirements of FOIA govern, and the agency must acknowledge the existence of any records it holds."); see also Vaughn v. Rosen, 484 F.2d 820, 827-828 (D.C. Cir. 1973) (calling for "itemization and indexing" of the withheld documents). The declaration is insufficient because it fails to provide any descriptive information about the documents withheld in their entirety, including how many of those there are. It fails to identify which specific exemptions the FBI relies on for each document that is being withheld. The FBI is ordered to file a Vaughn index that complies with the Court's previous orders by August 16, 2012. The Court denies the motion to compel with respect to the arguments advanced by plaintiffs concerning the adequacy of the search and the applicability of the claimed exemptions because they are more appropriately considered at summary judgment. The Court denies the request for sanctions at this time, and it notes that there is no need to stay summary judgment briefing since there is no briefing schedule in place.
