FOIA Project Annotation: A federal court in New York has ruled that the New York Times cannot challenge the FBI's release of data on Assessment Reports, which allow the agency to use authorized investigative techniques to gather information and intelligence on individuals and groups that may be involved in criminal activities or threats to national security, because the newspaper was now trying to get a different version of the data than what it had originally requested. Reporter Charlie Savage asked for the assessments and the agency withheld them, claiming Exemption 5 (privileges) as well as Exemption 1 (national security). But when the statistics were disclosed in a letter to the Senate Judiciary Committee, the agency told Savage that Exemption 5 was no longer applicable and gave him the materials sent to the Judiciary Committee. But once Savage had looked at the materials he realized that he needed more information. He asked the agency to further provide the data broken down by the types of investigations. The agency refused. The court noted that "the [newspaper's] Complaint does not make a claim that all assessment statistics be declared public. Plaintiffs' summary judgment motion nevertheless attempts to broaden their claims to all assessment statistics in an impermissible attempt to avoid mootness. Since the FBI's March 7, 2011 unredacted released of the Assessment Statistics provided to the Senate Judiciary Committee complied with Mr. Savage's FOIA Request in accordance with his later amended request, the NYT's November 4, 2009 FOIA request is now moot." The newspaper argued the case was not moot because the agency had shown a pattern and practice of improperly withholding the data under Exemption 2 (internal practices and procedures) and Exemption 7(E) (investigative methods and techniques). The court rejected that argument, pointing out that "defendant's initial withholding under Exemption 2 was not improper under circuit court case law at the time Exemption 2 was invoked. With regard to Exemption 7(E), the FBI released the request document after review by its subject matter experts revealed that the release of the assessment statistics requested by Mr. Savage would no longer harm a protected interest. Plaintiffs have failed to provide evidence of prior similar instances to support its claim that it is the policy or practice of the FBI to improperly withhold assessment statistics under Exemption 2 or Exemption 7(E)."
