The defendant's representations that rolling production of documents is now occurring and there "has been... a significant increase in speed of processing Plaintiffs request," 65 Def.'s Opp'n, further militates against certifying such an extraordinary appeal. Finally, the facts contained in the ex parte submission in support of the defendant's 17 Motion for Open America Stay, on which the Court based its ruling in part, have not changed.
