Case Description | Students for Sensible Drug Policy and Ross Wilson submitted a FOIA request to the Department of Education for records concerning a state-by state breakdown of how students applying for federal aid responded to questions about drug use. Students for Sensible Drug Policy also requested a fee waiver. The agency denied the request for a fee waiver. It disclosed six Excel spreadsheets responsive to the request, but Students for Sensible Drug Policy argued that the spreadsheets did not include state-by-state statistics. Students for Sensible Drug Policy filed an administrative appeal, which was denied. Student for Sensible Drug Policy then filed suit.
