2012-12-277MINUTE entry before Honorable Matthew F. Kennelly: On 10/22/12, the Court entered an order granting plaintiff leave to proceed in forma pauperis and ordering service of summons on defendant by the U.S. Marshal. The order directed plaintiff to cooperate with the Marshal as requested in effectuating service of summons. Plaintiff has failed to do so. Specifically, the Marshal has advised that plaintiff never returned the necessary forms that the Marshal sent to her. 2013-10-3131ORDER: The Court has reviewed plaintiff's objection to the Court's 10/10/2013 order and hereby overrules it. The Court's 9/9/2013 order was in fact served upon plaintiff to mailing it to her at the address she provided, which is in Serbia. The docket accurately reflects the service of this order. In any event, plaintiff concedes that she received the Court's 10/10/2013 order, which advised her that the case had been reinstated. The Court also overrules plaintiff's apparent contention that the Court, or the Clerk, is required to provide her with documents pursuant to Fed. R. Civ. P. 4(c)(1) or otherwise; rather, that Rule requires the plaintiff to provide copies of the complaint for service. Plaintiff, who filed this lawsuit in the first place, is reasonably expected to keep copies of documents she files with the Clerk (such as the complaint). That aside, the Clerk is directed to mail a copy of the complaint (dkt. no. 1) to plaintiff at her listed address.
