Case Description | EPIC requested records on BBG's involvement with Tor Solutions, Inc. and the "Tor Project," an encryption technique considered vulnerable to NSA surveillance. EPIC filed suit after the agency failed to respond to its request within the statutory time limits and to its subsequent administrative appeal. EPIC requested a fee waiver, which was denied by BBG. BBG has told EPIC that it provided Tor Solutions with the responsive records to permit it to comment on whether they were protected under Exemption 4 and that it expected to respond to the request within 15 more business days. It also noted that since it had missed the statutory deadline it would not assess fees.
