Case Description | Texas Roadhouse, Inc. submitted two FOIA requests to the Equal Employment Opportunity Commission. The first request was for records concerning the funds spent by the agency investigating and litigating a case against Texas Roadhouse. The agency acknowledged receipt of the request. The parties had several email exchanges, but the agency did not provide any further response to the request. The second request was for all age discrimination complaints or investigations involving Texas Roadhouse. The agency acknowledged receipt of the request, but although Texas Roadhouse made several inquiries about the status of its request, the agency did not provide any further response to the second request. Texas Roadhouse then filed suit. Texas Roadhouse filed suit before the agency responded to its first three requests. The agency responded ten days later by withholding certain records. Texas Roadhouse then submitted its fourth request and the agency estimated it would cost $24,000 and asked Texas Roadhouse to narrow the request. Texas Roadhouse refused to do so and instead amended its complaint to include the fourth request as well. The agency argued Texas Roadhouse had failed to exhaust its administrative remedies because it had failed to file an administrative appeal, while Texas Roadhouse claimed it had constructively exhausted its administrative remedies because the agency responded after it had filed suit. However, the court found that Texas Roadhouse's decision to amend its complaint required the company to administratively challenge the agency's search and exemption claims at that point. Because there was some confusion about whether or not Texas Roadhouse had received the agency's cost estimate for its fourth request, the court allowed Texas Roadhouse to respond to the cost estimate and administratively appeal the claim.
