FOIA Project Annotation: A federal court in New York has ruled that the Bureau of Prisons has provided all disputed records to Corey Davis. At this stage of the litigation, the court considered Davis' requests for video surveillance tapes and phone calls he made from prison. The court found BOP had properly responded to both requests. The court noted that Davis' attorney had confirmed that he received two discs containing the video surveillance tapes. As to the phone calls, the court pointed out that it had previously ruled that BOP already had adequately responded to Davis' request. The court indicated that "pursuant to the 'law of the case' doctrine, Plaintiff cannot raise the same issue, via a subsequent motion to compel, that has already been decided by the Court."

FOIA Project Annotation: A federal court in New York has ruled that the Bureau of Prisons properly responded to the remaining portions of Corey Davis' FOIA request for records pertaining to names and register numbers of inmates housed in cell block 3 at Manhattan Detention Center from March to May 2009. The agency withheld identifying information under Exemption 7(C) (invasion of privacy concerning law enforcement records). The court found the records were compiled for law enforcement purposes, noting that "at a minimum, this information is assembled to permit the BOP to timely provide [the bed assignments] to law enforcement officials when needed, maintain security within prison confines, identify prisoners who may pose specific risks and/or need to be separated from particular groups of inmates, and prevent prisoner escape." While Davis argued that inmates did not have an expectation of privacy in such information, the court pointed out that claim had been previously rejected by the Second Circuit. Balancing the inmates' privacy interest with the non-existent public interest, the court observed that "plaintiff has failed to demonstrate that disclosure of the inmate names and register numbers would serve a cognizable public purpose such that the information may not be withheld under the privacy exemptions as he has not provided any justification, let alone a sufficiently weighty justification, for disclosure of the information sought."

TSA and BOP have now renewed their motion for summary judgment, and plaintiff has failed to oppose their motion despite generous extensions from the court. For the reasons set forth herein, TSA's and DHS's 102 motion for summary judgment is granted in its entirety, and they are dismissed from this suit. BOP's and DOJ's motion is granted in part and denied in part. The denial of BOP's and DOJ's motion in part is without prejudice, but they should be mindful of the need to sufficiently meet FOIA search requirements, and carefully explain how they have met those requirements, or why exemptions apply, before bringing another motion for summary judgment in this case. McMahon (who has not appeared for Plaintiff in this action), and 2) release to Plaintiff all telephone calls placed from FCI Beckley. As to the second issue, the District Judge's 8/14/2014 Opinion noted, "BOP provided plaintiff with recordings of the requested [FCI Beckley] telephone calls together with the information about those calls, which was an adequate response." 104 at 8-9. According to Plaintiff, Debbie Stevens at FCI Beckley has refused to produce the requested recordings. On or before 3/12/2015, Defendants will file a letter response. If Defendants agree to Plaintiff's requests, Defendants will propose an expedited schedule for compliance. If Defendants do not agree, the Court will schedule a telephone conference. As described therein, the BOP has demonstrated that it has fully complied with the three directives contained in the Court's August 14, 2014 Summary Judgment Order as: (1) the BOP conducted an adequate records search that identified the names, register numbers, and bedding assignments of all inmates housed in cell block 3 of MDC between March 1, 2009 and May 31, 2009; and (2) properly redacted the inmate names and register numbers as exempt pursuant to statutory exemption § 552(b)(7)(C) because this information is gathered for law enforcement purposes, implicate a significant privacy interest, and Plaintiff has failed to demonstrate "that release of the information would shed light on the workings of government." Associated Press v. United States DOJ , 549 F.3d 62, 66 (2d Cir. 2008). A copy of the attached Order has been mailed to Plaintiff at the address reflected on the docket.
