However, a court may deny leave to amend for undue delay, bad faith, dilatory motive, repeated failure to cure deficiencies, and futility of amendment. Foman v. Davis, 371 U.S. 178, 182 (1962). Where the complaint, as amended, would radically alter the scope and nature of the case, and any proposed amendment bears no more than a tangential relationship to the original action, leave to amend should be denied. Wolf v. CIA, 569 F. Supp. 2d 1, 11 (D.D.C. 2008). Plaintiff seeks to amend his complaint over two years after filing his original FOIA request and seeks to recover documents from an agency that has no involvement in this case. Allowing Plaintiff to bring new tangentially related claims, involving an entirely new party, will further delay the resolution of the limited issues remaining in this case.
