Plaintiff Rosario Guzzi filed a Freedom of Information Act (FOIA) request with U.S. Citizenship and Immigration Services (USCIS), Department of Homeland Security. Because of the nature of the documents requested, USCIS transferred the request to Immigration and Customs Enforcement (ICE). ICE reported that it was unable to find any documents that satisfied Guzzi's FOIA request. After a denial of Guzzi's administrative appeal, he filed a Complaint in this court. Assistant United States Attorney Anita Johnson, as an officer of the court, has reported that ICE has conducted a search reasonably calculated to uncover documents responsive to Guzzi's FOIA request and found none.
