Now, the parties have filed a joint motion to extend the mediation deadline (Doc. # 18 ), seeking an extension of the mediation deadline to October 1, 2018. In the motion, the parties represent they have largely resolved their dispute and that they believe they will reach an agreement about a few remaining documents within two weeks. The Court applauds the advances the parties have made toward resolution of this case. But, because the parties are still attempting to resolve the release of a few documents, the Court believes that mediation will aid the parties at this time. Accordingly, the motion is denied. 2018-09-11 | 20 | ENDORSED ORDER: After the Court entered its order denying the joint motion to extend the mediation deadline (Doc. # 19), counsel for the parties jointly contacted chambers to provide information that the parties failed to include in their motion. According to the parties, the mediation scheduled for tomorrow September 11 would be unsuccessful because the IRS is still internally reviewing whether the remaining documents may be released - a process that cannot be resolved during the mediation. Furthermore, the Court was informed that Ware is out of state, despite the September 11 mediation having been scheduled since May. The Court is disappointed that the parties failed to earlier seek an extension of the mediation deadline from this Court and that the parties failed to arrange for their presence in Tampa to attend the scheduled mediation. The Court is especially disappointed with the handling of the situation by counsel for the IRS, who knew about the delay with the internal review of documents but failed to notify the Court and waited until the afternoon before the scheduled mediation to seek an extension. Nevertheless, given the additional information provided by the parties, the Court sets aside its earlier order (Doc. # 19) and grants the joint motion to extend the mediation deadline (Doc. # 18 ).
