Case DescriptionCitizens for Responsibility and Ethics in Washington submitted three FOIA requests to the Department of Justice for records concerning the cost of trips related to John Dunham's review of the origins of the government's investigation of Russian interference in the 2016 election. CREW also asked for expedited processing for its second and third requests. DOJ acknowledged receipt of the requests and denied CREW's requests for expedited processing. After hearing nothing further from the agency pertaining to any of its three requests, CREW filed suit.

FOIA Project Annotation: Judge Emmet Sullivan has ruled that the Department of Justice properly responded to two FOIA requests from CREW for three spreadsheets concerning the costs of the Review conducted by John Durham, U.S. Attorney for the District of Connecticut, into allegations of impropriety during the investigation into whether the Trump campaign had colluded with Russia during the 2016 presidential campaign. CREW's FOIA requests were sent to the Office of Information Policy and the Executive Office for U.S. Attorneys. OIP identified two spreadsheets as responsive. The first spreadsheet included the names, salaries, and home offices of the members of members of the Review, while the second spreadsheet identified travel information, including the identities of officials making the trip, the duration of the trip, and a breakdown of costs. OIP told CREW that it would withhold the two spreadsheets entirely under Exemption 7(A) (interference with ongoing investigation or proceeding). EOUSA told CREW that it had one responsive spreadsheet, containing the identities and salaries of the investigators for the Review, as well as information about travel expenses. EOUSA also told CREW that it would withhold the spreadsheet entirely under Exemption 7(A). Sullivan first found that OIP and EOUSA had conducted an adequate search, a finding that CREW had not challenged. Turning to the Exemption 7 (A) claim, Sullivan noted that "the Review needs to track the identities of its members as well as its travel and other expenses to maintain an organized investigation. Second, there is a connection between the records and a possible violation of federal law because the members of the Review â€" a law enforcement investigation being conducted by DOJ â€" are investigating possible violations of federal law." CREW argued that the records were too far removed from any law enforcement purpose. However, Sullivan explained that "here, DOJ has demonstrated that the records are directly related to activities in furtherance of the Review." CREW also argued that the records were created to process their FOIA requests by creating spreadsheets. Sullivan noted that "it is not fatal that DOJ has compiled information it stores elsewhere into spreadsheets to fulfill this FOIA request. The Supreme Court has instructed that 'information initially contained in a record made for law enforcement purposes continues to meet the threshold requirements of Exemption 7 where that recorded information is reproduced or summarized in a new document prepared for a non-law-enforcement purpose.'" Sullivan indicated that "there is no dispute that the Review constitutes a pending or reasonably anticipated law enforcement proceeding within the meaning of Exemption 7(A). An ongoing investigation that is likely to lead to future enforcement proceedings is enough to invoke the exemption." Sullivan also found that information identifying salaries and costs was properly protected under Exemption 7(A). CREW argued that it was "unaware of any way to extrapolate from salary information to the identity of a prosecutor or investigator." However, Sullivan indicated that "disclosure of individual salaries would disclose information about the scope and breadth of the Review. And because the members of the Review are compensated on a highly structured pay scale, disclosure of this information would provide the number of members of the Review, and from that information could likely be extrapolated the general professional credential of each member, such as attorney, investigator, paralegal, etc. Disclosure of this information logically could reveal at least the scope of the investigation."
