2021-11-08MINUTE ORDER: Plaintiff filed his 1 Complaint on October 1, 2020. Defendant filed a 12 Motion to Dismiss pursuant to Rule 12(b)(1) and 12(b)(6) on March 3, 2021. Plaintiff filed a 17 Motion to Amend Complaint on March 10, 2021. Defendant filed a 19 Motion to Stay its response to the Amended Complaint, pending the Court's resolution of the Motion to Dismiss, on March 29, 2021. Plaintiff thereafter filed a 20 Motion for Extension of Time to respond to the Motion to Dismiss; an 21 Opposition to the Motion to Dismiss; and a 22 Motion to File an Amended Opposition to the Motion to Dismiss after discovery. Plaintiff was entitled to amend his Complaint as of right within 21 days of service of Defendant's motion under Rule 12(b). See Fed. R. Civ. P. 15(a)(1)(B). The document that Plaintiff filed as his Amended Complaint, however, is defective because it apparently is intended to be read in conjunction with the Complaint, instead of as a document that supersedes the Complaint. See Barnes v. District of Columbia , 42 F. Supp. 3d 111, 117 (D.D.C. 2014) ("When a plaintiff files an amended complaint as of right within 21 days after the filing of the motion to dismiss under Rule 12(b)..., the amended complaint becomes the operative pleading..., and any pending motion to dismiss becomes moot."); 6 Fed. Prac. & Proc. 2d § 1476 (explaining that an amended pleading "under Rule 15(a) supersedes the pleading it modifies and remains in effect throughout the action unless it subsequently is modified"). Accordingly, the Court will GRANT Plaintiff's 17 Motion to Amend the Complaint IN PART, and will require Plaintiff to file a Second Amended Complaint that includes all of the claims and causes of action that he wishes to pursue in this action. Plaintiff's Second Amended Complaint is due by December 6, 2021. Failure to timely file the Second Amended Complaint may result in dismissal of this action. Defendant's 12 Motion to Dismiss and 19 Motion to Stay are DENIED as moot. Plaintiff's 20 Motion for Extension and 22 Motion to File Amended Opposition after discovery are DENIED as moot. 2022-03-02MINUTE ORDER. On February 25, 2022, the Clerk of Court entered default against Defendant in this case. Defendant filed a 30 Motion to Vacate Default on February 26, 2022. Defendant represents that he inadvertently failed to file a response to Plaintiff's 29 Second Amended Complaint because he mistakenly believed that a dispositive motion was pending. On March 1, 2022, Plaintiff filed a 32 Motion for Entry of Default, which the Court will construe as an opposition to Defendant's 30 Motion to Vacate Default. Pursuant to Federal Rule of Civil Procedure 55(c), the Court may set aside an entry of default "for good cause shown." See Fed. R. Civ. P. 55(c). To demonstrate good cause, "the moving party [must] provide an explanation for the default or give reasons why vacation of the default entry would serve the interests of justice." Haskins v. U.S. One Transp., LLC , 755 F. Supp. 2d 126, 129 (D.D.C. 2010) (alteration in original) (quoting 10A Charles Alan Wright, Arthur R. Miller, Mary K Kan, & Richard L. Marcus, FED. PRAC. & PROC. CIV. Section 2696 (3d ed.)). Because courts "universally favor trial on the merits," Keegel v. Key West & Caribbean Trading Co. , 627 F.2d 372, 375 (D.C. Cir. 1980), and because the Court finds good cause to vacate the default here, Defendant's 30 Motion to Vacate Entry of Default is granted, and Plaintiff's 32 Motion for Default is denied. It is not the case that merely filing a Motion to Extend Time stays the deadline; thus, Defendant has missed the July 29, 2022 cut-off. Moreover, Defendant filed his Motion to Extend Time the day before the July 29, 2022, deadline, in violation of the Court's standing order. See General Order (ECF No. 2), at 5 (requiring Motions to Extend Time to be filed at least two (2) business days prior to expiration of the deadline (emphasis in original)).
