2022-05-09MINUTE ORDER. Upon consideration of the plaintiff's 8 Motion to Consolidate Civil Actions, it is hereby ORDERED that the motion is GRANTED. Local Civil Rule 40.5 provides for the consolidation of related cases when multiple cases "(i) relate to common property, or (ii) involve common issues of fact, or (iii) grow out of the same event or transaction or (iv) involve the validity or infringement of the same patent." LCvR40.5(a)(3). Here, the plaintiff seeks to consolidate this case with 22-cv-876-DLF. Both of these cases deal with plaintiff's FOIA requests regarding information about the government's criminal investigation and prosecution of him, and both named the EXECUTIVE OFFICE FOR UNITED STATES ATTORNEYS and the DEPARTMENT OF JUSTICE as defendants. Accordingly, the Court concludes that these cases involve common issues of facts and should be consolidated. Furthermore, the Court notes that this plaintiff has another FOIA suit in front of it, Moreno v. Department of Justice , 22-cv-82-DLF, which names the DEPARTMENT OF JUSTICE and the DRUG ENFORCEMENT AGENCY as defendants. Upon review, it appears that all three of these cases share common issues of fact and thus should be resolved together. Accordingly, it is hereby ORDERED that the Clerk of Court CONSOLIDATE all three of these cases into the docket of the lead case, Moreno v. Department of Justice , 22-cv-82, and add "EXECUTIVE OFFICE FOR UNITED STATES ATTORNEYS" as a defendant in 22-cv-82. It is further ORDERED that the complaints in 22-cv-194 and 22-cv-876 shall be placed on the docket of 22-cv-82 on the dates they were filed in those respective cases. Upon doing so, the Clerk of Court is directed to close cases 22-cv-194 and 22-cv-876. The Clerk of Court is also directed to mail a copy of this minute order to the plaintiff's address of record at his facility of incarceration. So Ordered by Judge Dabney L. Friedrich on May 9, 2022.
