In the Report, Plaintiff requests an order "instructing the [Terrorist Screening Center], not the FBI, to come into compliance with all requirements of FOIA, including publicly publishing rules for processing and handling FOIA requests" and requiring both agencies to issue "separate and distinct declarations... identifying which agency responds to the requests made to this lawsuit via its production." Based on the representations made by the Parties, the Court does not see good cause to intervene at this time. The relationship between the agencies is a matter of public record. To the extent Plaintiff is challenging the adequacy of the search (and if that dissatisfaction cannot be resolved by conferring in good faith with the agency), Plaintiff is free to make that argument in a dispositive motion, when such motions are filed. The Court further finds that it is not necessary to require the Parties to file their next report on an accelerated schedule, as requested by Plaintiff. The Parties are therefore ORDERED to submit their next Joint Status Report by July 17, 2023.
